Terms and Conditions

Clause n°1 : Object

The terms and conditions written right after gives details about High Garden’s rights and obligations and his client concerning sell of : Ghee Nature, Ghee au Curcuma, Ghee à la Cannelle and Ghee aux 7 épices.
Any delivery made by High Garden involve the buyer adherence without reserve to these terms and conditions.

Clause  n°3 : Prices

Prices sold are the current one the day of taking order. They are in euros and taxed price (French tax). They will be increased by the transportation costs the day of the order.
High Garden has the right to change her prices at any moment. However, it commits to bill the merchandises ordered to the prices indicated at the moment of the order.

Clause n°4 : Discounts

The prices proposed are composed by discounts that High Garden will have to take off in view of its results or the fact that the buyer take in charge some of the benefits.

Clause n°5 : Advance payment

No discount will be made in case of an advance payment.

Clause n°6 : Terms of payment

Settlement of payments can be made by Paypal only.

Clause n°7 : Delivery

Delivery by Colissimo 48-72 h at home or by Mondial Relay 72h.

With Mondial Relay, a unique shipping cost for any order.

With Colissimo, shipping costs are computed from the weight of the order.

• Up to 750 grams, maximum corresponds to sending 3 small pots or 1 large pot
• Up to 1 kilo, maximum corresponds to sending 4 small pots or 2 larpe pots
• Up to 2 kilos, maximum corresponds to sending 8 small pots or 3 large pots
• Up to 5 kilos, maximum corresponds to sending 21 small pots or 11 large pots
• Up to 10 kilos, corresponds to the maximum of 40 small pots or 20 large pots

A delivery delay is given at the moment of order but only as an indication.

Then, any reasonable delay can’t be used by the buyer to have benefits like:

• Indemnification
• Cancel of the order

If you receipt a damaged package, please take a picture of it contact us at contact@highgarden.fr. We will deal with your request as quickly as we can.

Clause n° 8 : Cancel and retractation

Customer has pursuant to the provisions of the Consumer Code, Article L 121-16 and following on distance selling, a withdrawal period of 14 days from delivery date of the product or products ordered online to exchange or cancel an order.

High Garden reserves the right to refuse any exchange of merchandise as soon as it has been opened. The return and exchange fees are the responsability of the customer. In case of cancellation, you will be refunded only the price of the goods ( shipping costs are the responsability of the customer).

Clause n°9 : Force majeure

High Garden’s responsibility couldn’t be questioned if any of the last clause is not respected by the buyer or not made completely and correctly. Then, the force majeure extends to any exterior event, unexpectable and irresistible to the sense of the Article 1148 of the French Civil Code.

Clause n° 10 : Regulation of consumers disputes

In accordance with Ordinance No. 2015-1033 of August 20, 2015, its implementing decree No. 2015-1382 of October 30, 2015, articles L.611 to L.616 and R612 to R616 of the Consumer Code, the customer consumer, subject to Article L.152-2 of the Consumer Code, has the option of submitting a request for an amicable resolution by mediation within a period of less than one year from his written complaint to the professional.

This institution has designated the SAS Mediation Solution as a consumer mediation entity.

To seize the mediator, the consumer must formulate his request:

Whatever the means of referral used, the document must contained :

• E-mail, phone number and adress of requester
• Name and adress of the profesional concerned
• Brief statement of facts,
• Proof of the preliminary steps undertaken with the professional

Clause n°11 : Competent court

Any dispute relative to the interpretation and to the execution of the present terms and conditions is submit to the French right.
In case of failing on an amicable resolution, the dispute would be brought to the Tribunal de Commerce de Lyon.
